Syracuse, N.Y. - Attorney General Letitia James’ Office has cleared Syracuse Police officers in the shooting death of a man in a wheelchair:
On May 13th Syracuse Police were called to an apartment building on North Townsend Street for a man firing a weapon.
They found Donnell Hogan, on the second floor in a wheelchair, armed with a pistol. After refusing commands to show his hands, Hogan raised the gun and fired at the officers. One of the officers returned fire striking Hogan and killing him.
James' office says, under New York’s justification law, a police officer may use deadly physical force when the officer reasonably believes it to be necessary to defend against the use of deadly physical force by another.
The AG's office says the use of deadly force against Hogan was justified, and charges will not be filed.
