In Syracuse, David Kirby, 35, has been sentenced to 40 years to life in prison for the murder of 26-year-old Apreona Harris, who was pregnant at the time of her death. The sentencing took place on Monday (April 21), following a swift jury conviction in March.

Harris was fatally shot in the head by Kirby on the morning of December 15, 2023, near the Rescue Mission in downtown Syracuse. Despite her critical condition, doctors were able to deliver her baby, who survived. The incident was captured on multiple security cameras, showing Kirby approaching Harris and shooting her after a brief argument.

During the trial, Syracuse Police Detective Mamoun Abraham testified that he witnessed the argument and recognized both individuals due to their previous romantic relationship. After the shooting, Kirby attempted to flee but was apprehended by police after being struck by an unmarked police vehicle.

Kirby was convicted of second-degree murder and two counts of criminal possession of a weapon. Despite the overwhelming evidence, Kirby's defense argued that he was not in his right mind during a police interview following his arrest. However, the jury sided with the prosecution, which argued that Kirby's presence and actions were not coincidental.

Kirby plans to appeal the sentence. The case has drawn attention due to the tragic circumstances and the swift conviction. Harris' family and friends, who described her as a free-spirited woman working to improve her life, were present during the trial and sentencing.
