AG's Office Steps Back from Brooks Case, DA Fitzpatrick Steps In

The New York Attorney General's Office, led by Letitia James, has recused itself from the investigation into the death of Robert Brooks, an inmate at Marcy Correctional Facility. Brooks, 43, died on December 10, 2024, after an altercation with correction officers the previous day. The decision to step back was made because the AG's office is representing some of the officers involved in civil lawsuits, which presents a conflict of interest.

Attorney General James explained that while her office is confident in its internal safeguards, even the appearance of a conflict could hinder the prosecution. Therefore, the case has been handed over to Onondaga County District Attorney William Fitzpatrick, who will serve as the special prosecutor. Fitzpatrick has over 30 years of experience and is well-equipped to handle the complex investigation.

The incident, captured on video, shows multiple officers restraining and hitting Brooks. Thirteen state employees have been suspended without pay, and one has resigned. Brooks' death has prompted calls for the closure of Marcy Correctional Facility.

Governor Kathy Hochul expressed her expectation for swift legal action, stating that the video evidence clearly shows crimes were committed. The FBI and U.S. Justice Department are also reviewing the case. Brooks was serving a 12-year sentence for a 2016 stabbing incident.
