CNY Pride is calling for the resignation of Syracuse City Court Judge Felicia Pitts Davis after she allegedly refused to marry a same-sex couple due to her religious beliefs. The incident occurred on November 16, when Judge Pitts Davis reportedly declined to conduct the wedding of Shawntay and Niccora Davis, despite having married a heterosexual couple the same day. Another judge stepped in to perform the ceremony for the women.
The refusal has sparked outrage among local advocacy groups, including CNY Pride, which described the judge's actions as "despicable" and contrary to her judicial oath. The matter has been referred to the State Commission on Judicial Conduct. According to a spokesperson for the State Office of Court Administration, judges who choose to perform marriages must not unlawfully discriminate against couples.
Local officials have also voiced their disapproval. Syracuse City Auditor Marion, the only openly LGBTQ+ person in citywide office, has called for Judge Pitts Davis to resign or face suspension. Onondaga County District Attorney Bill Fitzpatrick expressed concern about potential bias in cases involving same-sex couples, stating he would seek to have Judge Pitts Davis recuse herself from such cases if her actions were confirmed as discriminatory.
The controversy highlights ongoing tensions surrounding same-sex marriage, which has been legal in New York State since 2011. CNY Pride President Jimmy Monto, also a Syracuse Common Councilor, emphasized the importance of upholding the law without bias and maintaining integrity in judicial roles.
