Albany, N.Y. - A judge has struck down New York's ban on flavored vaping products.
The judge granted a request from the Vapor Technology Association for an injunction against enforcing the emergency ban.
The judge ruled the state Public Health and Health Planning Council overstepped its authority when it issued the ban, and noted that regulating the vaping industry was a job for the state legislature.
The ban was put into place in September, and followed an outbreak of vaping-related illnesses and deaths across the country.
