Utica, N.Y. - The man that killed and chopped up the bodies of his grandmother and her landlord won't stand trial.
Two licensed psychologists evaluated Naythen Aubain. They found he was incompetent for trial. Aubain is accused of killing his grandmother Katerine Aubain and his landlady Jane Wentka and chopping up both their bodies.
Aubain will be locked away at an institution where he will be continually evaluated. The Oneida County DA is seeking a Grand Jury filing to allow him to be prosecuted should he ever be cleared for trial.
Aubain had been out enrolled in a Mental Health Court at the time of the gruesome killings. Last February, Aubain tried to strangle his grandmother who he eventually murdered and mutilated.
