Cop Cleared Of Criminal Charges In 'Rough' Arrest At Nottingham

Syracuse, N.Y. - A Syracuse police officer is cleared of criminal charges for a physical altercation with a 14-year-old boy.  

School Resource Officer Vallon Smith was arresting and removing a suspended Nottingham High School who had been suspended and was refusing to leave. During the arrest Officer Smith fractured the teens elbow. 

Onondaga County DA Bill Fitzpatrick announced that an investigation showed the boy resisted arrest and Smith acted appropriately.  He added that any effort to target Smith in the future will not "pass muster" with the DA's office.

Fitzpatrick also said there was no evidence to back up the claim by the child's mother that the student was ever diagnosed as autistic.

The DA also praised the Syracuse Citizen Review Board for turning the case over to his office to look into.
