Tully, N.Y. - State Police are continuing to investigate after they arrested a Tully Junior-Senior High School student earlier this week.
16 year old Gavin Maloney from Preble was charged with felony first-degree rape this morning in Tully court.
Superintendent Rob Hughes wrote in a letter to parents that the assault occurred in a vehicle on the high school campus after school hours on Tuesday. Hughes also stated that in addition to the state's investigation, he is looking into imposing disciplinary actions related to the school's Code of Conduct.
Onondaga First Chief Assistant District Attorney Rick Trunfio says that the allegation was made by a fellow student, a 15 year old female.
Maloney is being held on $25,000 bail and will be back in Tully Town Court on Sept. 22.
