Rochester, N.Y. - A panel of judges in Rochester are considering reinstating the murder indictment of a retired North Syracuse Elementary School teacher.
On Independence Day 2017 James Ball shot and killed his brother-in-law. Ever since, lawyers have been arguing whether or not it was in self-defense.
Last August, Ball's indictment was tossed out after his lawyers successfully argued that testimony from Ball's wife, who was a wittness, was suppressed. A judge tossed out the indictment. Yesterday, a panel of State Supreme Court Judges heard from Prosecutors in Onondaga County about why that indictment should be reinstated.
Ball remains free on bail, but still faces murder charges.
