Central NY Vape Shop Owner Arrested for Illegal Sales

A Central New York vape shop owner, Richard Dechick, has been arrested for allegedly selling vape juice illegally through the mail. Dechick, who owns Vape Kult in Auburn, is the first person in New York to be charged under a public health statute that took effect in 2020. This law makes it illegal to ship vapor products or cause them to be shipped.

According to the New York State Department of Health, Dechick was charged with two counts of unlawful shipment and transport of vapor products, a class A misdemeanor. Vape Kult, his business, was also charged. If convicted, Dechick could face jail time, a fine, or both. The business could also face a fine.

The arrest is part of the state's ongoing efforts to combat youth vaping. State Health Commissioner Dr. James McDonald emphasized the public health risks posed by e-cigarettes, particularly for adolescents. "This arrest is a direct result of the state's dedication to decreasing vaping, especially among young people," Dr. McDonald stated.

Dechick is scheduled to appear in Niskayuna Town Court in Schenectady County on February 12. If there are any subsequent violations following a conviction, they would be classified as a class E felony.
