Sleepy Juror Nearly Causes Mistrial In Astacio's Latest Trial

A sleepy Syracuse Juror almost caused a mistrial for a former Rochester judge who is accused of trying to buy a gun while on probation.

Former Rochester Judge Leticia Astacio was on probation for driving drunk on her way to work. During that time prosecutors say she tried to buy a shotgun from two Dick's Sporting Goods Stores. She was denied twice.

The trial was moved to Syracuse because of media attention in Rochester.

Her trial almost came to a screeching halt when one of the jurors fell asleep during most of the closing arguments. Fortunately, an alternate juror managed to stay awake and is taking part in deliberations.

The drowsy juror was dismissed.
