No Charges For Tully Man Who Killed A Salina Man While He Mowed Lawn

New York State Police has said there will be no criminal charges levied against a 28 year old man. 

Shawn Cleary will only be ticketed for unsafe moving from a lane. 

On May 16th Cleary drifted off the road, striking 73 year old Thaddeaus Florczyk from behind as he was mowing his neighbor's yard. Florczyk was thrown by the impact and landed about 15 yards away while the riding lawn mower was thrown about 30 yards. Florczyk was pronounced dead at the scene.

Cleary states at the time that he was working with his glasses and drifted off the road.
