Judge To Rule on Murder Charge for Saccone

It's up to a judge to decide if the man accused in the death of three current and former OCC students can be charged with murder.

Anthony Saccone is charged in the deaths of Baylie Rose, Michael Walker, and Samra Osmonovic on February 23.  Investigators say they believe Saccone was drunk and had taken cocaine before the fatal car crash at Onondaga Boulevard and Onondaga Road.  

Saccone's attorney says there is insufficient evidence for three murder charges while District Attorney Bill Fitpatrick stands by the charge of depraved indifference murder.  The judge will hear arguments from both sides and will likely issue a ruling on the murder charge by July.
