A doctor at St. Josephs Hospital is in the clear after allegations that he slapped patients on the hind end and used vulgar language in the operating room.

DA Bill Fitzpatrick says after interviewing dozens of witnesses, no charges will be brought against Doctor Michael Clarke, an orthopedic surgeon.

Clarke is accused of slapping both male and female patients on the buttocks in the operating room after being knocked out and using vulgar and sexually suggestive language.

The DA says he could not come up with any evidence that his actions were for sexual gratification and witnesses couldn't indentify which patients were in the operating room when they observed the doctor's alleged conduct.

Fitzpatrick says there is insuifficient evidence to support a viable criminal prosecution.

The doctor claimed he was simply checking to see whether patients were fully under the affect of anesthesia.
